Annotation

Scientific and legal examinations in the modern lawmaking process is one of the acute issues that are actively discussed in legal science and lawmaking spheres. It is a scientifically sound approach to expert’s activity in lawmaking that ensures the quality of an array of normative legal acts adopted by the Parliament of Ukraine and other state bodies within their powers.

Properly governed and professionally performed expertise at the stage of preparation and discussion of the legal act not only allows to ensure the proper level of its preparation, but also contributes to the creation of an interconnected and mutually agreed system of legal acts, which can minimize the positive effect of the adoption of a legal act or significantly reduce its regulatory impact.

Expertise is especially important today, when the adoption of effective, legally correct acts, the accuracy and precision of legal formulations and definitions often become a determining factor in the correct formation of the state development vectors. International practice suggests that the involvement of experts in the preparation of regulations can meaningfully improve the quality of legislative material.

Development and adoption by the Parliament of Ukraine at the end of 2021 in the first reading of the draft Law of Ukraine “On Lawmaking” updated discussions on the concept, objectives and role of scientific and legal expertise, including its impact on development and the quality of legislation.

Consolidation of generalized approaches to independent legal expertise in lawmaking will significantly improve lawmaking quality and efficiency of the Parliament of Ukraine, which in turn will inevitably increase the role of the legal profession in the modern Ukrainian state.
