Annotation | The article is focused on the legal aspects of ensuring product safety in economic turnover. Both national legislation and the EU requirements for product safety are studied. The conclusion on the ensuring product safety in economic turnover is substantiated to be legally defined as a set of measures taken by producers, distributors, state market surveillance authorities to provide compliance of goods launched into the commodity turnover of the Ukrainian market with the general safety requirements for both food and non-food products. Product safety is defined as a property that provides the possibility of the product being placed in the commodity turnout, on the market. Safety performance indicators are used to characterize the ability of the product to prevent injuries (mechanical, electrical, fire, chemical indicators), emission of harmful substances to humans or the environment (carcinogenic, toxic, allergic, mutational, etc.), exertion of dangerous physical effects, radiation, electromagnetic, noise, etc.). Product safety performance may encompass indicators of different groups (for example, functional or ergonomic) under a high degree of negative impact. Safety performance indicators reflect the requirements that determine the set of measures and means of human protection in an emergency situation, not authorized and not provided by the operating rules in a potentially danger zone. The requirements for the consumer protection from harmful effects on health in a potentially hazardous area should also form the basis of safety performance indicators. It is established that all goods imported into the customs territory of the EU must meet all the EU requirements aimed at ensuring consumer protection. These requirements differ significantly depending on the specifics of product type, but in general can be grouped into the following categories: 1) technical requirements classified by sectors of product safety, technical standardization, packaging and product labeling; 2) environmental requirements for goods supplied to the EU market consist of the following main elements: regulation of trade in hazardous chemicals, control of persistent organic pollutants; Registration, Evaluation, Authorization and Restriction of Chemicals (REACH); classification, labeling and packaging of substances and mixtures; requirements for plant protection products and biocides; 3) requirements in the field of sanitary and phytosanitary measures (SPS) providing that goods imported into the customs territory of the EU must meet the sanitary and phytosanitary requirements of the EU for the protection of human and animal health. The EU requirements for the product safety performance in each of the outlined areas have been analyzed.
