| Annotation | With the introduction a constitutional complaint in Ukraine, individuals and legal entities now have the opportunity to defend their constitutional rights and freedoms in the Constitutional Court of Ukraine personally, rather than indirectly. However, statistics indicates a low level of understanding and compliance with the requirements of the Law of Ukraine “On the Constitutional Court of Ukraine” by the persons having the right to a constitutional complaint. The article highlights the most relevant mistakes of persons addressing the Constitutional Court of Ukraine with a constitutional complaint. The purpose of this article is to highlight the most relevant mistakes of persons lodging a constitutional complaint. The analysis of decisions rejecting constitutional complaints shows that the main reasons for them are: the constitutional complaint does not contain substantiation of the allegations concerning the unconstitutionality of the disputed provisions of the laws of Ukraine; the constitutional complaint is lodged by an improper subject; the deadline for lodging a constitutional complaint has been missed. Each of the above reasons is revealed and examined. The conclusion is made about the ways of overcoming the problem and a range of steps for increasing the number of admissible constitutional complaints is outlined. |
