Annotation | The right to freedom of peaceful assembly as one of the human rights and freedoms attracts the attention of researchers who focus their research on the theoretical basis of the content of this right, as well as ordinary people who seek to understand the meaning and purpose of the right to freedom of peaceful assembly. to use the subjective will to realize one’s own interest in the form of the right to freedom of peaceful assembly. Social, economic, political, domestic and interstate globalization processes occurring at the beginning of the XXI century. necessitate a rethinking of the existing legal understanding of the right to freedom of peaceful assembly. Based on the above, the purpose of this article is to study the content of the right to freedom of peaceful assembly and the formation of a modern doctrine of legal understanding of the right to freedom of peaceful assembly. The process of intellectual understanding of the right to freedom of peaceful assembly, the formation of an established vision of the content of this right, expressed in specific legal formulas on the nature and functioning of the right to freedom of peaceful assembly will greatly affect the legal culture. real social relations, regulated by the rules of positive law, which will be based on the natural and legal principles of understanding the law in general and the right to freedom of peaceful assembly in particular. Legal understanding of the content of the right to freedom of peaceful assembly is possible, first, given the understanding of the content of the right to freedom of peaceful assembly, namely the awareness of understanding the elements of law and freedom in the content of this right; secondly, the formation of a single doctrine of the scope of the right to freedom of peaceful assembly, which cannot and should not be limited to the political component of human existence; thirdly, it is important to understand the condition of exercising the right to freedom of peaceful assembly, which is a wide field of realization of the possibilities of the individual, provided that the subjects of state power do not interfere in the private sphere; fourth, the understanding of the concept of “gathering”, which confirms the legal position on the identification of the right to freedom of peaceful assembly not only as a collective right, but also as an individual right; fifth, the formation on the basis of a general theoretical understanding of the content of the right to freedom of peaceful assembly established legal understanding of the doctrine of the content of the right to freedom of peaceful assembly and features of the mechanism (algorithm) of its implementation as an element of legal relations.
