Annotation

The so-called hybrid war launched by Russia against Ukraine in 2014, which turned into a full-scale war on February 24, 2022, and continues to this day, actualized not only the problem of improving domestic criminal legislation but also the revision of established concepts and approaches in legal science. First of all, it is about the criminal law protection of the foundations of Ukraine’s national security.

The purpose of this article is to establish the generic crime object of the first chapter “Crimes against the basic foundations of national security of Ukraine” of the Special Part of the Criminal Code of Ukraine.

 It was concluded that the National Security Strategy of Ukraine at the current stage should be implemented according to the principle “state security – human security”, and security itself is a concept that represents all the most important human values – life, health, honor, dignity, inviolability. It has been established that the general object ofcriminal law protection is embodied in the triad “state – society – person”, which is not fully matched by the modern name of the first chapter of the Special Part of the Criminal Code of Ukraine. Among the many definitions of national security, the most successful are those based on the concept of “the state of security”. Attributes of Ukrainian statehood are a priority in the context of criminal law protection because their vulnerability and insecurity create threats for each person and Ukrainian society in general.

There were supported proposals of scientists at the legislative level to adequately assess the degree of social danger of collaborative activity and to amend the sanctions of parts 1 and 2 of Section 1111 of the Criminal Code in terms of including the main punishment in the form of imprisonment. The importance of the state as an object of criminal law protection should not be underestimated, since an unprotected state is unable to protect the rights and freedoms of its citizens guaranteed by the Constitution. Therefore, it is proposed to change the title of Chapter I of the Special Part of the Criminal Code to “Crimes against the State”, which proposes to provide for criminal liability for the creation and operation of a criminal organization of anti-state orientation. Determining the grounds and conditions for the criminalization of such an act requires further scientific justification and consideration.
