Annotation

Collaborative activities are considered a phenomenon that was formed and exists on the territory of Ukraine, starting with the first stage of aggression of the russian federation against Ukraine (from 2014 till nowadays). Before the emergence of the norm on collaborative activities (Art. 1111 of the Criminal Code of Ukraine), the illegal cooperation of Ukrainian citizens in the education field was not properly assessed by law. Meanwhile, the mentioned ban, despite its advantages, is characterized by several defects, the presence of which complicates the interpretation of Part 3 of Art. 1111 of the Criminal Code of Ukraine, as well as its effective application in the future. The article is dedicated to solve these issues.

The article aims to resolve a complex of interrelated issues, which consist in clarifying: 1) approaches to the legal assessment of collaborative activities in the education field on the occupied territory of Ukraine before the appearance of the corresponding criminal law ban (Part 3 of Article 1111 Criminal Code of Ukraine); 2) limits of liability for the implementation of collaborative activities in the education field on the occupied territory of Ukraine under Part 3 of Art. 1111 of the Criminal Code of Ukraine; 3) parameters for improving the criminal law norm on collaborative activities in the education field.

The correctness of the legislator’s decision regarding the establishment of a special norm on collaborative activities in general (Art. 1111 of the Criminal Code of Ukraine) and in the education field in particular (Part 3 of Art. 1111 of the Criminal Code of Ukraine) is emphasized. Such an approach enables a more accurate qualification of the treasonous behavior of Ukrainian citizens on the occupied territory and creates the basis for proper differentiation of liability for its commission.

 The crime of collaborative activities in the education field was analyzed, which made it possible to determine the main guidelines for the interpretation of Part 3 of Art. 1111 of the Criminal Code of Ukraine in the absence of judicial practice, which has not yet been formed, and at the same time to identify several shortcomings of the relevant norm: difficulties in distinguishing from related elements of a criminal offense, as well as problems of understanding certain signs of collaborative activities in the education field, voluntariness as its quality, retroactive effect of part 3 of Art. 1111 of the Criminal Code of Ukraine.
