Article Unauthorized Dissemination of Militarily Significant Information: Issues of Criminal Law Qualification and Criminal Law Remedies Application

Annotation

Since the beginning of the current Russian-Ukrainian war, an independent subsystem of norms designed for application under martial law has been formed in the criminal law of Ukraine. Among the articles of the Criminal Code which embodies such norms, one of the most used in judicial practice and, at the same time, controversial in scientific cognition is Article 1142 which provides for criminal liability for unauthorized dissemination of information on the sending, movement of weapons, armaments and ammunition to Ukraine, movement or location of the Armed Forces of Ukraine or other military formations formed in accordance with the laws of Ukraine, committed under martial law or a state of emergency (militarily significant information).

The purpose of the article is to describe the corpus delicti of crimes provided for in Parts 1, 2 and 3 of Article 1142 of the Criminal Code, and the peculiarities of criminal legal remedies to be applied to persons whose actions are qualified under the above provisions.

The content of all the features of each element of the main corpus delicti provided for in parts 1 and 2 of Art. 1142, as well as qualifying features provided for in part 3 of this article, is established. Through a systematic interpretation of the provisions of the Criminal Code and other acts of legislation of Ukraine, the content of such ambiguously assessed in the literature features as the subject of this crime (information disseminated), the time of its commission (under martial law), guilt (direct intent in the main elements), motive, purpose, etc. is revealed. The issue of criminal legal remedies to be applied to the person who committed the crime under study is separately disclosed. Moreover, such remedies are defined systematically: both those provided for by the sanctions of Art. 1142 (punishment) and those that can be applied on the basis of the provisions of the General Part of the Criminal Code.

The reserves for further improvement of the criminal law provisions on liability for dissemination of militarily significant information, which can be implemented both in the current and in the future Criminal Code of Ukraine, are identified.
