Annotation | The article examines the specifics of legal regulation of labor relations in Ukraine during the armed aggression of the Russian Federation. They are caused by the introduction of martial law, labor migration, the emergence of new forms of labor organization, the expansion of remote work and the departure from stereotypes of the Soviet past in the legal regulation of labor relations. The authors support the need to adapt domestic labor legislation to the requirements of Directive No. 2019/1152 of the European Parliament and Council of June 20, 2019, on transparent and predictable working conditions in the European Union and its gradual approach to international standards. The application of remote work in the conditions of martial law and the strengthening of the implementation of digital technologies in the legal regulation of labor relations are analyzed. The necessity of changing the approaches to the accounting of the employee’s labor activity and expanding the possibilities of the contractual procedure for its establishment are emphasized. It is pointed up the need to return to the Labor Code of Ukraine such a feature of the labor contract as the performance of work subject to internal labor regulations. The employee’s right to perform remote work abroad is substantiated if the appropriate technical capabilities are available. Some aspects of the suspension of the employment contract and the possibility of its application in the conditions of martial law are clarified. |
