Annotation | The article analyzes the legal principles of the admissibility of information exchange between enterprises operating on the relevant market; the main characteristics of types of information, forms of exchanges, as well as market structures in the context of compliance with competition legislation are disclosed. On the example of specific cases, the European practice of proving and termination of violations of competition legislation in the form of information exchanges between enterprises, which led to the restriction of economic competition, was analyzed. Based on the results of the research work, proposals were developed for the Antimonopoly Committee of Ukraine to provide advisory clarifications regarding some issues of the application of Article 6 of the Law of Ukraine “On Protection of Economic Competition” and analytical materials on the qualification of violations of competition law in the form of anti-competitive information exchanges between enterprises operating on the relevant market, based on the consideration of cases in the member states of the European Union.
