Annotation | The article deals with the issues relevant to the modern law based state, related to the definition of specific areas of development of the doctrine of criminal procedural law. The authors emphasize that in the current reality of judicial reform, which is accompanied by an active law-making process, there is a growing demand for in-depth doctrinal researches, which should further harmonize existing criminal procedure law with the European Union law, international and European standards and its progressive evolutive dynamics, in order to justify the need for legislative changes and additions to the mechanism of criminal procedural regulation of relevant relations between the parties of the criminal proceedings, verification of their doctrinal justification and compliance with modern realities. Within the article, the authors draw attention to the most important issues from the criminal procedural law point of view, including the state of doctrinal developments in the theory of criminal procedural functions, the institute of special criminal proceedings in the form of in absentia – special pre-trial investigation and special court proceedings which has become a novelty of the reformed criminal procedural legislation of Ukraine; admitting the vital need for justice, citizens and society to introduce simplified criminal proceedings, the authors also warn against the inadmissibility of abuses by the prosecution during the inquiry, which could negatively affect the guarantees of rights, freedoms and legitimate interests of participants in such simplified proceedings. The article also develops the opinion that, despite the important theoretical significance and practical demand, the institution of review of court decisions on newly discovered or exceptional circumstances remains largely “in the shadow” of procedural doctrine. Evidence of this is the fact thatsince the adoption of the new CPC of Ukraine this institute has not been a separate subject of monographic researches, which cannot but affect the effectiveness of its legal regulation. Emphasizing the fact that legal doctrine has an important mission as a leading tool for scientific forecasting, the authors outline promising areas for further research, since it is a legal doctrine that should intellectually nurture the reform process. In this context, the authors highlight the need for appropriate legislative support for the digital transformation of criminal proceedings; proper legal support for the functioning of the Bureau of Economic Security, a body with unique powers that differ significantly from traditional notions of the competence of the pre-trial investigation body. Also, the authors emphasize that the processes of globalization taking place around the world determine the demand for comparative research, which allows to compare legal procedures, models, institutions, norms, to dive deep into the essence of legal regulators that exist in other countries in order to adopt a truly positive experience, without allowing the divergence. In the article, the authors address other topical issues that are important for ensuring the evolutionary dynamics of criminal procedural law and legislation.
