Article Grounds for Forced Termination of Land Ownership in the Conditions of the Legal Regime of Maritime State in Ukraine

Annotation

The article is devoted to the legal analysis of the legislative support of the grounds for compulsory termination of the right of private ownership of land and the emergence of state ownership of these land objects in the introduction of martial law in Ukraine.

The purpose of the study is to comprehensively study the principles of land regulation of legal norms in the legislation on the grounds of compulsory termination of land ownership, state acquisition of ownership, determine the content of grounds for compulsory termination and study the legal processes of land transfer to state ownership. martial law.

The article analyzes the current legal framework for the forced termination of private ownership of land, the transfer of owner’s rights from individuals to the state under martial law. The legal content of such grounds for termination of the right of private ownership of land plots as confiscation, requisition, nationalization, forced alienation and forced seizure of land plots into state ownership has been studied.

According to the results of the research, gaps in the current legislation in the field of forced seizure of land into state ownership under the legal regime of martial law and proposed ways to resolve legal conflicts.

The elaboration of the topic is based on the provisions of the general theory of land and civil law. The article provides conceptual recommendations for regulating the grounds for compulsory termination of land ownership, taking into account the latest advances in modern science of land law. The research was conducted on the basis of an analysis of the provisions of Ukrainian civil law on the conditions and forms of forced alienation and seizure of land.

The existence in the legal regulation of different in form, content and procedure for the application of procedures for the forced alienation of land in favor of the state. Compulsory termination of the right of private ownership of land in the order of application of the grounds for such termination of the rights of the owner in martial law entails the emergence of the right of state ownership of land. Compulsory expropriation of land should provide for advance payment for the property claimed from the owner. The procedure of forced confiscation of land for the needs of the state (requisition) may provide for the following reimbursement.

The publication proposes ways to resolve legal conflicts by systematizing the grounds for forcible termination of private land ownership in martial law and filling gaps in legislation and developing a separate legal act regulating the procedure for forcible termination of land ownership.

 The article provides coverage of current issues and legislative features of the termination of land ownership and the acquisition by the state of landowner rights under martial law.
