Annotation | On February 24, 2022, at 5 o’clock in the morning, the Ukrainian people felt for themselves what the merciless word “war” means. On this terrible day for all of us, Russia openly attacked Ukraine, starting, as they emphasize, a “special operation”. However, this word is not at all suitable for a groundless, brazen, large-scale and military invasion of the territory of a sovereign State. This is war! A war whose time must be counted since 2014, when the Russian Federation annexed Crimea. It was then that the latter incited conflicts between the population living in the territory of Luhansk and Donetsk regions. After February 24, 2022, it became clear that not only the Ukrainian people were not ready for this, but also Ukrainian legislation, in particular, the Criminal Law. The Verkhovna Rada of Ukraine has adopted a number of laws in a relatively short period of time, the purpose of which is to improve the criminal law regulation of social relations in the conditions of martial law. One of these laws is: Law of Ukraine “On Amendments to the Criminal Code of Ukraine Regarding Liability for Illegal Use of Humanitarian Aid”, which entered into force on April 3, 2022. By this Law, the Criminal Code of Ukraine was supplemented with Article 2012 “Illegal use for the purpose of obtaining profit from humanitarian aid, charitable donations or free aid”. The article analyzes different opinions of scientists regarding the need for criminal liability for the illegal use for profit of humanitarian aid, charitable donations or free aid. It also expressed its own opinion on the expediency of such responsibility.
