Annotation

A constitutional complaint to the Federal Constitutional Court is a particularly important institution for the German legal system: it is a highly respected opportunity for citizens to review the violation of their constitutional rights in an independent instance after the exhaustion of the normal judicial process. The high level of trust enjoyed by the Federal Constitutional Court among the population indirectly affects the reputation of the entire German state. But also from a legal point of view, a constitutional complaint is an important tool for protecting the constitution and its fundamental principles. While specialized courts mainly consider specialized law within the framework of common law, the fact that the compatibility of specialized law with the fundamental values of the constitution can also be considered by an independent court that does not belong to either jurisdiction should not be underestimated. Thus, the constitutional complaint is the cornerstone of the constitutional order in Germany.
