| Annotation | Determination of international and national mechanisms for overcoming the environmental consequences caused by the armed aggression of the Russian Federation against Ukraine is conditioned by the need to properly certify the facts and extent of damage to the environment of Ukraine with a view to further establishing the necessary compensation for environmental losses caused by the aggressor-state. The need for a practical vision of the application of these legal mechanisms and consideration of past international experience in this area is an urgent issue for the effective application of legal regulation tools and measures at both the national and international levels. The purpose of the article is to analyse the international legal and national mechanisms for overcoming the consequences of the damage caused by the Russian Federation to the environment of Ukraine, taking into account the current national and international legislation, and to highlight the experience of how they can be implemented in practice. The results of the study are based on the well-known facts of the existing irreparable damage caused to all areas of the environment of Ukraine, as well as the sources of threats and risks to human life and health, which have caused a critical state of the environment and require immediate legal and practical ways to eliminate the consequences of environmental emergencies and possible prevention. The authors examine the means and measures of legal regulation and response of state, public and international institutions aimed at overcoming the environmental consequences of the aggressive military actions of the Russian Federation against Ukraine. In particular, the authors draw attention to the system of environmental control of Ukraine in the context of long-term environmental risks and hazards, and the possibility of their prevention through the involvement of international institutions in the field of environmental control of Ukraine in the context of hostilities. Based on the national and international legislation and similar experience of other countries, the authors of the study conclude that the effectiveness of national legislative acts is more formed and focused in terms of their application in the areas of environmental damage compensation, while international mechanisms functioning as the basis of the institutional platform for damage compensation require further regulation and changes during the ongoing armed aggression of the Russian Federation against Ukraine. |
