| Annotation | The article provides a comprehensive analysis of international standards for the enforcement of court decisions and their implementation in the Ukrainian legal system. The study examines the enforcement bodies in Germany, the United Kingdom, and the United States, particularly focusing on their public and private enforcement agencies. Key aspects of the functioning of these systems, including efficiency, protection of parties’ rights, and control mechanisms, are identified. In Germany and the United Kingdom, the focus is on the integration of public and private enforcement agencies, ensuring a comprehensive approach to the enforcement of decisions and providing a high level of debtor rights protection. The judicial control systems in these countries, including the ability to appeal against the actions of enforcers and the effectiveness of rights protection mechanisms, are analyzed. In the context of the United States, a less centralized system is considered, where significant roles are assigned to private debt collectors, with regulatory peculiarities at the state level being noted.A comparison is made with the Ukrainian system, which combines public and private enforcement agencies with an emphasis on controlling the activities of enforcers. Based on the study, conclusions are drawn about the need to improve the Ukrainian system of enforcement of court decisions. Recommendations are proposed for the integration of international experience, including improving judicial control mechanisms and reforming the institution of private enforcement officers, which would enhance the efficiency of enforcement and provide greater protection of the rights of all parties. |
