The article is devoted to the analysis of the conceptual historical and legal foundations of the state-building by ancient Ukrainian communities in the context of the Great Migration of Nations era events.

The ideological basis of the research is the author’s position that the contemporary social and political structures of the Slavic communities, in particular the Antes, Sklavenis, Dulebes-Volhynians, became the basis for the formation of Ukrainian statehood. Through the prism of currently existing concepts and theories of social development, it is clarified how and to what extent the Ukrainian path in this format correlates with their key provisions.

The scientific and research basis consists of professional scientific works of foreign and domestic authors and a relatively wide range of historical sources: written records, archaeological and historical research, ethnographic and linguistic conclusions. Special attention is focused on the criticism of the false views of Western European historians (in particular, A. Toynbee, Germanocentrists), who underestimated the degree of the Slavic communities development, and it is illustrated that the Antes and Sclavenis at the early stages of evolutionary progress reached a sufficiently high level of social and political organization in the context of the formation of their own statehood. The expediency of using neo-evolutionary theories of social development for the analysis and evaluation of the ancient Ukrainian communities state-building is substantiated. This made it possible to consider the genesis of statehood as a complex, multidimensional process in which the customs, traditions and culture of the Ukrainian people in general are reflected and crystallized.

The influence of external factors (migration processes, interaction with other cultures, military threats) and internal transformations (social stratification, industrial relations level increase, complication of management structures) on state-building is analyzed.

As a conclusion, it is summarized that the processes of the Ukrainian statehood formation during the Great Migration of Nations era are correlated with similar phenomena of a pan-European scale and progress and became the basis for the formation of Kyiv-Rus state and laid a solid foundation for the centuries-old tradition of Ukrainian state-building.
