The study of the scientific heritage of prominent representatives of Ukrainian criminallegal science has not only theoretical significance for generalizing and systematizing the accumulated knowledge, but also direct practical significance. The latter consists both in saving the resources of current and future generations of researchers, and in providing them with a theoretical basis and tested tools for setting and solving new tasks that were not solved by their predecessors. Therefore, in legal studies in general, and in criminal-legal studies in particular, a separate direction is being formed, which has already been called “personal doctrinology”, within which the current issues of application and development in the present of the creative heritage of our predecessors are studied.

An important component of personal and doctrinal research in criminal law is the study of the creative heritage of the academician of the National Academy of Legal Sciences of Ukraine, the long-time first vice-rector of the Yaroslav Mudryi National Law University, Professor V. Stashis (1925–2011). The centennial anniversary of his birth became a kind of catalyst for such research.

The purpose of the article, in view of the above, was to study the creative heritage of Professor V. Stashis in the field of the doctrine of punishment in the context of the modern development of the criminal legislation of Ukraine.

As a result of the research, it was established that the system of punishments is a separate element (subsystem) within the general system of criminal legal remedies under the legislation of Ukraine.In this regard, the system of punishments and its individual elements are characterized by common features of the entire system of criminal legal remedies, and they are all united by a single goal.

Within the framework of the penal system, its individual elements are influenced by both the general systemic properties of the penal system itself and the even more general properties of the entire system of criminal law remedies. In particular, this requires unconditional adherence to the sequence of placement of individual types of punishments in the system in order of increasing severity; establishes its own requirements for the features of a separate element of the penal system, which are unlikely to be possessed by such a new type of punishment as probation supervision; makes it impossible to recognize special confiscation as a type of punishment, etc.

Based on the above, a number of theoretical and applied conclusions have been formulated, which are reduced to the following. First, personal and doctrinal research is an important direction of modern jurisprudence and has prospects for development into interdisciplinary scientific research.

Second, the ideas formulated by Professor V. Stashis regarding the penal system remain relevant today and, on their basis, not only already adopted but also promising legislative decisions can be evaluated. Thirdly, on this basis, some of the novelties of the current Criminal Code of Ukraine regarding the system of punishments, in particular, the introduction of probationary supervision, should be critically assessed, which, in turn, gives grounds to additionally substantiate some of the possible promising innovations, in particular: the system and types of punishments under the draft of the new Criminal Code of Ukraine.
