Annotation

It is noted that, at the present time, methods of law-making at the national level either do not perceive the concept of “risk” at all, or, if they do operate with this category, they take into account only to a limited extent the sources that allow for risk assessment considering the diversity of impacts that may arise, particularly in light of new challenges generated by technologies that, by their nature, remain potentially hazardous.The purpose of the study is to substantiate scientific and practical approaches to the formation and legal consolidation of a risk management methodology that meets the modern requirements of EU law.

It is argued that EU law has developed a comprehensive methodological framework for conducting complex research and assessing draft legislative initiatives through a system of indicators that makes it possible to identify the presence or absence of evident or latent risks for society. Compared to EU legislative practice, it is demonstrated that national law-making requires substantial improvement through the integration of a risk-based approach into legislative procedures.

It is highlighted that the preventive function of the risk management mechanism within lawmaking procedures is not fully implemented, thereby reducing the resilience of the national legal system under conditions of extraordinary existential challenges faced by the state.

It is further emphasised that law-making is not limited to the aim of preventing risks created by the legal acts themselves, since an important purpose of legislative activity remains the development and incorporation into the legal system of regulatory instruments that are capable of preventing the transformation of potential negative impacts of risks, characteristic of a specific sphere of social relations to be regulated, into the realm of actual, existing legal relations.

Thus, the risk management mechanism contributes to enhancing the effectiveness of legal activity at the level of law enforcement and implementation, which is partly reflected in the legislation of Ukraine.
