| Annotation | The article examines specific aspects of the protection of human information rights in the case law of the European Court of Human Rights (ECtHR) under the conditions of fullscale military aggression against Ukraine and the imposition of martial law in the country. The study emphasizes that modern privacy is acquiring new forms and requires an enhanced level of protection, especially in the context of cyber threats and restrictions introduced as part of the martial law regime. It is underscored that the implementation of international standards in the field of access to public information and personal data protection is a key benchmark for Ukraine as a member state of the Council of Europe. The purpose of the article is to explore the peculiarities of the protection of human information rights in the ECtHR’s jurisprudence, to analyze the impact of the legal regime of martial law introduced in Ukraine on the implementation of this legal mechanism, and to provide specific recommendations for incorporating ECtHR case law in the development of information law and order. Considerable attention is devoted to defining the criteria for permissible interference with private life (legality, legitimate aim, proportionality, and necessity in a democratic society) and their application in judicial practice (decisions in P.N. v. Germany, Sabuncu and Others v. Turkey, S. and Marper v. the United Kingdom). A separate section of the article analyzes the ECtHR’s approach to the right of access to public information, which is considered an integral component of the freedom of expression. In particular, the criteria established in the case of Magyar Helsinki Bizottság v. Hungary are presented, which are used to assess the justification for restricting access to information. The case Centre for Democracy and Rule of Law v. Ukraine is examined to assess the compliance of national authorities’ actions with the above standards. In conclusion, the article highlights the need to strengthen the protection of information rights under martial law, to improve national judicial practice by incorporating ECtHR approaches, and to further integrate international standards into Ukraine’s domestic legal system. It is recommended to enhance the law enforcement practice of Ukrainian courts through regular monitoring of decisions for compliance with ECtHR criteria and to intensify the activity of the Supreme Court in generalizing European case law in the field of information rights. |
