| Annotation | Based on the analysis of doctrinal sources, legislation of the European Union and Ukraine, the article reveals various conceptual approaches to the interpretation of the phenomenon of “electronic democracy” and its correlation with other similar categories. Attention is drawn to the constitutional and legal framework for the establishment of e-democracy at the national and local levels in Ukraine, and the existing problems in this context. Thus, in the context of the martial law regime, it is urgent to develop and adopt an updated Concept for the Development of Electronic Democracy, taking into account the development of AI, blockchain technology, Big Data processing tools etc. Undoubtedly, the development of local e-democracy is one of the key factors for effective and efficient communication between citizens and government institutions, their informed and transparent decision-making, as well as for the restoration and reconstruction of Ukraine through stimulating local initiatives involving investment. At the same time, the concept of Europe’s digital transformation by 2030, set out in the Digital Compass 2030, which sets out the EU’s strategic course for digital transformation, focused on a human-centered, sustainable and secure digital future, the introduction of smart platforms for communities (Smart Data), smart villages, etc. Successful implementation of local e-democracy in Ukraine and the EU requires finding an optimal model and identifying successive stages. The emphasis is placed on the specifics of the model of J. Hiller and F. Belanger, which provides for five for the development of local e-democracy in Ukraine. In general, the level of regulation in the EU of the principles, forms and mechanisms of local e-democracy is far ahead of the state and quality of legal regulation of e-democracy in Ukraine. National legislation in this area lags far behind, so we believe it is necessary to urgently adopt a new concept for the development of e-democracy, taking into account existing international and European standards, the challenges and threats of martial law, and the prospects for post-war reconstruction. |
