| Annotation | The essence of justice as a value is revealed. The artificiality of dividing values into universal, European and national is shown. It is proved that justice is a European, universal and at the same time national value. The author analyzes justice as a value in its political and legal dimension and determination by Ukrainian national interests. Justice is defined as an integrative value in the interaction of politics and law. Different methodological approaches to the definition of justice are shown. The anthropocentric approach to politics and law is based on the understanding of a person as a political creature, i.e., as a subject and object of socially oriented governance to achieve the common good on the basis of justice. The structural-functional approach focuses on the analysis of a just society where various social functions are properly fulfilled and balanced, and thus the good of justice is likened to the pursuit of the common good. Such an analogy makes justice the highest good of the political order. The axiological method is used to study justice as a moral virtue. Justice as a common good, as an idea of what is proper in law and social relations (i.e., a political category) is most fully comprehended within the framework of philosophy of law, social philosophy, and philosophy of politics. Therefore, the principle of the ought is considered within the framework of such a trend as “legal criticism”. The author argues that a person and justice combine fundamental values which determine the sense and direction of politics and law, and the socio-political organization of the State. Therefore, there is every reason to define a person and justice as political and legal values, to assert the dialectical interdependence of these values and the inappropriateness of their separation as separate subjects of scientific analysis. This necessitates the integration of these and other methodological approaches |
