The problem of the loss and the desired restoration of normativity is increasingly becoming a key issue for the modern world in general and for law in particular. This aspect gains particular relevance in the context of the extraordinary state of Ukrainian society, where classical models of normativity prove to be insufficient – not only in the sphere of ensuring law and order, but also in virtually all areas of state functioning. The purpose of the article is to clarify why a crisis of normativity emerges within in modern social systems, including law, to identify the ways of overcoming it, and to determine whether the restoration of normativity is forming into a new scientific paradigm or is becoming an increasingly urgent necessity for humanity. Based on an analysis of the situation in Ukraine and scholarly developments on this issue, it is substantiated that the loss of the normativity of law has a number of factors, including: the destruction of trust in law, which is equivalent to the reduction of law to mere coerciveness; the adoption of norms devoid of moral or social content, rendering them unacceptable to society and unclaimed in legal practice; total universalization or, conversely, excessive individualization of norms; the conditions of full-scale war; so-called everyday “non-law” (informal normative practices) as a manifestation of deformed marginal social normativity; digitalization and code-based algorithmizing of law, which potentially poses the risk of technological dominance over legal normativity; the neglect of classical approaches to legal understanding, and others. It is concluded that the problem of the loss and restoration of normativity is fundamental for many sciences, and above all for the theory and philosophy of law, which are called upon to develop a new scientific paradigm of the revitalization of the normativity of law, taking into direct account the urgent problems of Ukrainian society – war, transitional justice, reforms, and trust in government and the state.
