The article considers the problems of development of legal regulation of family and inheritance relations in the field of private international law. The issues of historical development of legal regulation of international family and international inheritance relations since the proclamation of independence of Ukraine are studied. The existence of conflict-of-laws rules in the Code on Marriage and Family, the inclusion of conflict-of-laws rules of family law in the Family Code of Ukraine, the problems of codification of the rules of private international law in the draft of the current Civil Code, the adoption of a separate law “On Private International Law”. The process of recodification of civil legislation, especially conflict of laws of family and inheritance law, their importance in the regulation of private relations with a foreign element is considered in detail. The purpose of the article is to analyze the existing conflict of laws on family and inheritance relations, to determine the type of codification that will be the most acceptable in modern conditions, to offer your vision of this problem. The article describes the peculiarities of the influence of the general principles of private law and the conflict principles of the private international law on the development of conflict regulation of specific types of family and inheritance relations. The problems and proposed options for conflict regulation of the right to marriage, the form and procedure for marriage, the peculiarities of marriage in a consular office or diplomatic mission of Ukraine, the actual family union, the termination of marriage, the regulation of personal and property relations of spouses, the marriage contract, maintenance obligations, etc. are analyzed. The author also dwells on the problems of conflict regulation of hereditary relations.
