The article provides a comprehensive study of the role of commercial courts within the system of the State’s economic security, examined through the lens of their function in ensuring the stability of economic turnover. The paper substantiates the need to reconsider the traditional approach to defining the purpose of commercial courts, which is typically confined to dispute resolution, and demonstrates their significance as an institutional factor in shaping a predictable and coherent legal environment. The author proposes original definitions of the categories of economic security, the system of the State’s economic security, and the stability of economic turnover of the State. The study distinguishes the stability of economic turnover from related concepts, including legal certainty, economic security, and investment attractiveness. It further develops a classification of risks inherent in economic turnover (legal, transaction, behavioural, and systemic) and substantiates the role of commercial courts in mitigating these risks. An original definition of the category of court-determined stability of economic turnover is proposed as an integrated economic and legal characteristic reflecting the systemic impact of judicial activity on the functioning of economic relations. It is demonstrated that effective judicial protection should be regarded not only as a mechanism for restoring violated rights, but also as an instrument for stabilizing economic turnover and ensuring the State’s economic security. The article develops a multi-level system of criteria for assessing the effectiveness of commercial courts, encompassing structural, functional, and outcome-based indicators, including the level of predictability of judicial decisions and the effectiveness of enforcement of judicial acts.
