| Abstract | Contemporary challenges of war and post-war reconstruction have placed environmental rights at the center of legal and political discourse, as wartime urban planning requires the integration of ecological standards into development, construction, and territorial management. The purpose of this article is to outline a model of urban planning in which such standards serve as a prerequisite for harmonizing recovery with environmental preservation. An analysis of doctrinal approaches by Ukrainian has enabled the construction of an architecture of environmental rights grounded in constitutional foundations. Doctrinal provisions and practical implementation mechanisms form the superstructure of this framework, encompassing three blocks of legal regulation: natural resource law, environmental protection law, and the law of ecological safety. International experience – such as the reconstruction of Berlin after World War II and the rebuilding of Sarajevo following the Balkan conflicts – illustrates diverse models of combining legal mechanisms with practical instruments. Of particular importance is the French Environmental Charter (2005), which confirms the necessity of constitutional reflection on environmental rights. Comparing international models with the Ukrainian context demonstrates a shared goal: integrating environmental rights into urban planning law as a fundamental element of sustainable development. Environmental rights must become the core of reconstruction, ensuring ecological safety, environmental protection, and alignment with the EU acquis. Their critical reflection within international projects can help avoid the risks of urbicide – the destruction of urban environments that threatens cultural authenticity and ecological resilience. Universal legal dilemmas of wartime are resolved through transparency, public participation, and adherence to international standards. |
