Abstract

The functions of the state are changing, the system of social relations is becoming more complicated, the interdependence of political, economic, social, information and technological processes is increasing. Under such conditions, national security can no longer be considered as a separate area of state activity. It becomes an integral property of the legal system, reflecting its ability to ensure the stability of the state’s development, legal certainty, consistency of the activities of institutions and the protection of national interests. The purpose of the article is to develop a holistic concept of the legal model of the formation and preservation of the national security of Ukraine, determine its structural elements, study the competence of state authorities in the mechanism of implementing the state security policy, as well as formulate proposals for improving the legal regulation of the system of ensuring national security in the context of the transformation of the functions of the modern state and the European integration of Ukraine. The results of the study concluded that the improvement of the current legal model should be carried out in several interrelated areas: – legislative consolidation of the concept of the legal model of national security; – improvement of strategic planning mechanisms; – regulatory and legal development of interdepartmental coordination; – strengthening of democratic civilian control; – harmonization of Ukrainian legislation with modern European and Euro-Atlantic standards. Thus, the prospects for the development of the legal model of the formation and preservation of national security of Ukraine are directly related to the transition from a predominantly institutional approach to a functional and legal model of public administration.
