| Abstract | The article is devoted to the study of the possibilities of borrowing individual elements of the French model of constitutional control to improve the constitutional justice of Ukraine. The relevance of the topic is due to the need to increase the efficiency of the functioning of the institute of constitutional complaint, optimize the procedures of constitutional justice and search for optimal models for the development of the national system of constitutional control in the context of European integration. Modern scientific approaches to the issues of constitutional reception are analyzed, as well as doctrinal provisions on the admissibility and limits of borrowing foreign constitutional experience. Particular attention is paid to the development of the French model of constitutional control after the constitutional reform of 2008 and the introduction of the mechanism of the priority preliminary question on constitutionality (QPC). The features of the procedure for preliminary selection of constitutional appeals, the terms of consideration of cases, as well as the use of reservations on interpretation as one of the tools for ensuring a balance between the constitutionality of regulatory acts and the stability of legal regulation are studied. It is substantiated that the improvement of the constitutional justice of Ukraine should be carried out not by mechanically transferring the French model, but by adapting its individual elements to the features of the national constitutional system. Practical directions for improving the activities of the Constitutional Court of Ukraine are proposed, which concern the optimization of the mechanism of preliminary selection of constitutional complaints, the determination of procedural deadlines for their consideration, and the expansion of the legal tools of the Court through the use of reservations on interpretation. It is concluded that a critically understood constitutional reception can contribute to increasing the efficiency of constitutional justice provided that it complies with national constitutional values, principles, and features of the legal system. |
