| Annotation |
The provisions on transparency in the Association Agreement between Ukraine and the European Union are studied in the article. The concept of transparency in the EU law is widespread. Moreover, its essence varies due to the field of application. The relevant General Agreement on Tariffs and Trade/World Trade Organization practice where transparency is one of the fundamental principles of global trade regulation was the factor contributed to the development of transparency concept in many areas of the EU trade and economic law. Legal grounds and basic tools for transparency adherence in WTO law are described. Structure of the provisions on transparency in the Association Agreement is determined. Particular attention is paid to the analysis of Title 12 of the Association Agreement. The basic mechanisms to ensure the transparency of measures of general application were emphasized. The implementation of the concept of transparency laid down in the Association Agreement will have a great impact on the legal system of Ukraine. |
