In article the comparative and legal analysis of judicial precedent and court practice is carried out. It is noted that within each legal system own idea of essence of judicial precedent, court practice, their role in regulation of the public relations owing to historical, national, state and legal and other factors was created. It is noted that now the discussion about expediency of recognition of decisions of the courts is conducted by judicial precedents. Supporters of recognition of judicial precedent by a source of the Ukrainian right pay attention that judicial precedents carry out the Significant role in legal regulation as thanks to them laws are concretized, blanks in the right are filled in. Opponents deny existence in Ukraine case systems of the law, though do not exclude such opportunity.
