| Annotation | It was formed a doctrine of the sociology of criminal law, in the article based on the research of Michael Gernet’s (1874–1953), which consist of the following items: humanism, an exception of cruel punishment in law, the possibility of prevention of crime, the equality before the law for all members of society, the link between crime and living conditions, the negative impact of the class character of the Russian Empire legislation. Correspondence of these doctrinal provisions to the specific grounds of legal doctrine is shown. |
