The article highlights the phenomenal role of contract as a universal legal construction of the mechanism of legal regulation of social relations. Contract law is one of the key institutions of the civil law, because legal regulation of relations of property turnover is provided by contract based on legal equality, free will and property independence of its members. During the period of the 10th anniversary of the CC of Ukraine of 2003, its main concepts and provisions have undergone significant changes and passed the test of time. However, some of the so-called «innovations» to the CC of Ukraine were not always caused by the logic of law making in certain areas of property relations, in particular in determining the subject of property rights on objects, which are amended to the construction contracts.

This article analyzes the court practice in disputes arising from the application of remedies for the protection of violated civil rights, and noted as an important direction for further development of the «contractual» legislation of Ukraine, its adaptation to the EU standards.
