In article the questions and factors of effective fundamental legal instituteof management of sport in Ukraine in interrelation with international and European standardsare considered. The problem aspects interfering development of sport as a result of use of theparadigm of the total state participation based on the imperative instructions of the legislationcreated at the time of communism are revealed. Taking into account conclusions of research it isoffered as the institutional legal basis of sport in Ukraine to implement at the level of the nationallegislation the principle of the autonomy of the sports sphere with the description of borders ofits application and contents.
