In the clause actual problems in sphere of protection of a trade secret in Ukrainewas researched. Directions of enhancement of the legislation of Ukraine in this sphere werespecified. Located that the central problem of the conceptual device in this question are absenceof the systematize legislation concerning a trade secret and the uniform approach to protectionof a trade secret in Ukraine. For a solution of a problem accepting of the separate law who wouldsettle legal status and ways of protection of the right to a trade secret are offered. The conceptof a trade secret as the information independent real or potential value as it are not well-knownare formulate and protect by the enterprise, and access to which are limit for the purpose ofprotection of the rights, legitimate interests are more its than the owner from wrongful accessto it, disclosure or use. According to the author, fastening of the concrete signs determine a tradesecret are reasonable.
