In the article the sources of the legal succession institute in a Roman private laware investigated. Socio-economic reasons of origin of the legal succession are analyzed, as wellas methods (forms) of transition of subjective civil rights. The author has made a conclusionabout the rising in the Roman law of the idea of capacity of property right to a transition,including to be a transition’s object in order of legal succession.
