Article Constitutional Justice in Ukraine: Primary Reasons of the Problems(in the Context of Constitutional Reform)

Annotation

The article draws attention to the extensively discussed in society, butsuperficially analyzed, problems of constitutional justice reform at the present stage of theUkrainian state development. In particular, there are identified the root causes of the currentissues emergence as the basis for research of constitutional justice actual problems and aprecondition for the reforms implementation. Providing the analysis of the dynamics of theConstitutional Court of Ukraine changing role in limiting state authority so as to ensure individualrights and freedoms of man and citizen, collective rights of communities and the entire Ukrainianpeople, there are outlined apparent and implicit obstacles for the constitutional justice in Ukraineefficient functioning, as well as a comprehensive analysis of the issues, their causes andconsequences is conducted. The article contains arguments proving objective relationshipbetween constitutional justice problems and national state building difficulties in general. Thus,the conclusion is made on the inadmissibility of «half-measures» adopting and introductionof formal amendments as a way of the constitutional justice system reforming in Ukraine.In contrast, there are given the author’s proposals concerning priority and fundamentaltransformations that are essential conditions for the constitutional justice in Ukraine development.
