| Annotation | The article investigates the state of legislative ensuring and court practice regarding assertion of the right to a fair trial in administrative justice of Ukraine. Legal bases for assertion of the right to a fair trial in administrative justice of Ukraine are defined in the article. Transparency of judicial process and its perpetuation by technical means is considered as one of the basic constitutional principles of justice. The restrictions on transparency of judicial process in administrative justice of Ukraine are defined. The author analyzed in details such structural element of the right to a fair trial as the publicity of the proceedings and declaration of the judgment. Legal positions of the European Court of Human Rights on this issue are provided in the article. Based on the analysis the author provided suggestions for the improvement of certain provisions of Code of Administrative Procedure of Ukraine. |
