Article Ensuring the Right of Persons Held in Custody or Serving a Sentence to Access to Administrative Court.

Annotation The procedural order of ensuring the right of persons held in custody or serving a sentence to participate in the court hearing is covered in the article. The author analyzed problematic aspects in the application of the videoconferencing regime and application of remote video proceedings, including the conditions and procedure execution of videoconferencing mode. It is suggested that provided by Non-Criminal Procedure Codes order of participation of a person in videocon ference shall apply only to persons who can independently come to court. The procedure stipulated in Article 336 of the Criminal Procedure Code of Ukraine must be applied in order to ensure participation of persons held in custody or serving a sentence in the hearing. Active use of videoconferencing in courts and penal institutions is an effective means of implementing the procedural rights of persons in custody or serving a sentence of imprisonment.
