| Annotation | Based on theoretical and legal positions the main issues in constitutionalization of the legal order are considered in the article. Constitutionalization is determined as the main aspect of the legal system. It advocates as one of manifestations of the direct action of the Constitution aimed at harmonization of social relations and the rule of law. The author emphasized that constitutionality of elements of the legal system and the rule of law are the result of constitutionalization. It is noted that constitutionalization of the legal order depends on the content of those values and principles laid down in the Constitution and stipulated by the peculiarities of the national legal system. Degree of effectiveness of the legal regulation of social relations depends on how basic constitutional principles and provisions are reflected in the legislation. |
