The concept of «breach of oath» is examined in this article, as well asdifferences between it and disciplinary offense. Furthermore the consequences of bringingto disciplinary responsibility and dismissal for violation of the oath are elucidated. As a resultof research were made the proposals about feasibility of developing clear features of theviolation of oath, the inadmissibility of the broad interpretation of this concept, as wellas dismissal for the political motives.
