Annotation | The article highlights cultivated in Ukraine (and sometimes in foreign countries) basic scientific approaches to the interpretation of the phenomenon and the concept of the rule of law, namely integrative and split-elementary. The author characterizes positive and problematic aspects of each. From a historical materialist position, the author reveals socio-anthropological and needs-oriented essence of fundamental rights as the core backbone of the rule of law. The article analyzes the content of the latest document the Venice Commission (approved by the Committee of Ministers), which stipulates empirical criteria for monitoring compliance with the rule of law. |
