Annotation | Based on the analysis of existing in criminology definitions of «criminality», the author demonstrates the necessity in characterizing the role and tasks of the state by covering relation of civil society to criminal offenses. Although the terms «criminality», «fight against crime» are hardly used in the text of the Constitution of Ukraine, the study of the content of the Constitution provides a basis for the conclusion that it actually contains a powerful set of constitutional anti-criminal legal norms. However, there was a blatant discrepancy between the requirements of the Constitution of Ukraine, the current legislation in relation to the human rights and freedoms, fighting against crime and the real governmental actions in Ukraine, especially over the last 3–4 years. The article highlights the sharp rise in the process of social and legal activism during mass demonstrations in the end of the previous year and in the beginning of this year, which are described as an «anti-criminal revolt» — a healthy response of civil society to the actions of criminalized government. In order to combine the efforts of civil society and the renewed government, the adoption of an updated long-term anti-criminal strategy of Ukraine (strategy against crime) is proposed, revealing its task, content, stages. |
