Article Extraterritorial Application of the EU Law: Experience for Ukraine

Annotation The article deals with the analysis of two fundamental doctrines of extraterritoriality — effect & nationality doctrine. It was described the origins of effect doctrine in American enforcement practice (in cases Alcoa, Hartford). The article consists the detained analysis of European Commission extraterritoriality enforcement of competition norms (cases Dyestuffs, Wood Pulp). Special attention is paid to EU Court practice via Ukrainian undertakings (for example, Javico v Yves Saint Lauren & ISD Polska sp. z o.o. and Others v European Commission). It was proved that the further liberalization & intensification of trade between Ukraine, EU & EFTA countries would lead to spreading EU competition norms within the Ukrainian entities.
