The article examines the critical issues related approach to an extreme(extraordinary) situation, which could happen in the country, a proper understanding of theterm, certain of its species and varieties. It has been suggested the possibility of a stateof emergency research by jurisprudence and interpretation of the state of emergency with theessential and legally point of view. The author offers his own definition of the extraordinarymode (state of emergency) in order to consolidate it in the legislation and it is indicated whichrisks it may carry for the entire legal system prevailing in the country. The article suggests for thefuture, as opposed to the state of emergency, to develop a mechanism which with well-definedcircumstances can make it possible for citizens to resist the authorities.
