Annotation The article is devoted to the development of the doctrine of civil law in intellectual property rights. Based on historical-legal research and existing theories of intellectual property rights the author concluded about the origins of the modern understanding of intellectual property rights, especially as the sub-sector of civil law. The condition of complex theoretical research in these areas, as well as some of the problems of intellectual property is analyzed. Compared is the content of national and foreign laws and international acts on its basic principles and specific rules in this area. Attention is drawn to the immutability of the traditional view of jurists on the legal nature of intellectual property as private. The author concluded on the state and prospects of doctrinal development as common problems of intellectual property and its individual institutions, the object and subject composition, rights and so on.
