This article presents the results of a scientific analysis on methodological issues of theoretical and legal research on the example of the concept of the judicial power. The author's approach to the gradual formation of the methodological component that will help provide effective results of the study and its conclusions will be based on a comprehensive, objective and thorough knowledge of the inner nature of the relevant concepts. Among the main stages of the methodological component of the theoretical and legal research proposed to define a common approach to the formation methodology; note specialization of research; determine the mode of application methods; make scientific analysis of available research methods, their types and classifications, further grouping their system and use in theoretical and legal research; specify the methodology, given the subject of study.
