Annotation | June 2, 2016 the Parliament adopted the Law on Amendments to the Constitution of Ukraine on justice that lies revised constitutional principles of the judiciary and related institutions — prosecutors and advocates. According to the legislator, constitutional changes in terms of justice, should promote the full-scale judicial reform and renewal of the judiciary in accordance with public expectations and in line with European standards, the restoration of public confidence in the judiciary and the proper functioning of prosecution and advocacy. However, certain provisions of the new constitutional provisions contain ambiguous perception and require critical evaluation of potential risk of abuse of the law in making these implementing laws. The article is devoted to the critical analysis of the provisions of the said amendments to the Constitution of Ukraine on justice and speak some proposals for the content of the law, which has to implement the new constitutional principles of justice. |
