Article Principles of the Constitutionalization of a Legal Order as Standard Basis of its Providing

Annotation

The article is devoted research of problems of konstitutsionalization legal order, principles of action of the given process. The specified problems are considered from this point of view leaderships of the Fundamental law. It is accented that in the course of legal order provision there is an interaction of bodies of the state to institutes of a civil society. The attention that as the basic conductor of such balance the Constitution acts is paid. Therefore provision and protection of the rights and freedom, strengthening of the law and order within the limits of activity of any body of the state is performed at Fundamental law level. It is proved that principles of konstitutsionalization of legal order closely intertwine with principles of the law and carry out together with them a basic role – observance of rates of the constitution by persons of law, their embodiment in all structural components of system of law and provision on this basis of an appropriate condition of a legal order. It is given reason that konstitutsionalization is necessary to consider as one of the major all-social conditions and are special-legal means of provision and protection of the rights and freedom of the person and the citizen, legality and law and order strengthening. On this basis it is offered to allocate among constitutional and общеправовых principles of the right a principle of konstitutsionalization which is basic idea of an embodiment in life of the constitution, its observance and conformity of the legislation its position.
