| Annotation | The prerequisites affirming the right to bring a class action stipulated in the procedural legislation of Ukraine are determined. The possible algorithm of applying procedural form of the right to bring a class action is outlined. The gradual introduction of class action, taking into account certain categories of cases (environmental protection, consumer protection, etc.), is proposed. The basic methods of detection of class proceedings are provided (while filing an appeal to the court and preparing the case to hearing). The necessity of determining the characteristics of procedural and legal status of the agent according to the class action is grounded. Taking into account the experience of foreign countries regarding the implementation mechanism for the protection of collective rights, the existence of individual elements of group proceedings in procedural law of Ukraine is determined. |
