| Annotation | The peculiarities of proof concerning civil suit in criminal proceedings are analyzed in the article. Moreover, the need of a special subject of proof in the civil suit is substantiated. The authors identify the construction of elements of the structure of this subject. The role of participants in the proceedings in proof of the civil suit as well as rules of division of responsibility and burden of proof in respect of the civil suit are determined. The authors have researched the way to settle the civil suit based on the results of evidentiary activities of parties in proceedings. Some shortcomings of regulation of the above institute are identified. |
