| Annotation | The article deals with important aspects of relation between pre-trial investigation and evidence. The necessity to address the issue of breaking the «chain» «constraining» prosecuting authorities and court in evaluation of pre-trial investigation concerning admitting it to be proof, and reserving the prior right of the court to evaluate these data was shown. The necessity to reject the practice of unilateral admission by the prosecution of the pre-trial investigation data as evidence in order to implement the principles of direct data examination in court was stated. |
